Provide sufficient supervisory personnel and resources
Assign sufficient personnel and commit adequate resources to fully and properly apply and enforce the firm’s supervisory policies and procedures.
Understanding the obligation
Rule 3905(1) requires a Dealer Member to assign sufficient personnel and commit adequate resources to fully and properly apply and enforce its policies and procedures. Written supervisory controls are therefore not enough if the firm lacks the people, capacity or support needed to carry them out.
The requirement is proportional to the work that must be supervised. The subsection does not prescribe a fixed headcount, staff-to-representative ratio or technology budget. Assessing sufficiency requires considering the actual scope of responsibilities and whether the supervisory processes can operate as intended.
Requirements
- Assign sufficient personnel to apply and enforce the firm's policies and procedures.
- Commit adequate resources for the full and proper operation of those policies and procedures.
Practical considerations Illustrative
